A denied claim isn’t the end of the road, and you don’t have to face what comes next alone. Most first-time Social Security disability claims filed in Nebraska come back denied, a reality that stops a lot of families before they ever reach a hearing. Liner Legal works with Nebraska claimants in Lincoln, Omaha, Grand Island, and every smaller community in between to rebuild denied claims and pursue the disability benefits they earned. Our disability attorney team handles every stage of the appeals process.
Whether your disability claim is sitting at the initial application, stuck after a denial letter, or waiting for a hearing date, our team can step in. We work the claim the way the Social Security Administration needs to see it: organized medical records, clear documentation of how your condition limits your daily life and work, and a legal argument that fits the rules.
See if You Qualify for SSD/SSI Benefits. It only takes about two minutes, and there’s no cost or obligation. It’s the fastest way for our Intake team to review your case and reach out to you.
Types of Disability Benefits Available in Nebraska
Several federal programs run side by side in Nebraska. Many claimants qualify for more than one.
- Social Security Disability Insurance (SSDI). For workers with enough work credits who can no longer do substantial work, meaning work that earns more than a set monthly amount, because of a physical or mental impairment. That’s built through years of work, and Social Security tracks it in work credits, so the longer and more recently you’ve worked, the more likely you are to meet the requirement.
- Supplemental Security Income (SSI). A needs-based program for disabled children and adults with limited income and resources, regardless of work history.
- Long-term disability (LTD) insurance through an employer. Many of these policies fall under federal ERISA rules, the law that governs most employer disability plans, with their own filing windows and appeals process.
Why So Many Nebraska Disability Claims Get Denied
Most disability claim denials in Nebraska come down to a few patterns. Insufficient medical evidence is the most common reason. Scattered, sporadic treatment, missing healthcare provider opinions, and applications that do not describe how the impairment affects ability to work make it easy for a disability examiner to say no.
Nebraska Disability Determination Services, the state agency that reviews your medical records and decides whether you qualify, reviews initial claims and reconsiderations on behalf of the Social Security Administration. The standards are the same as every other state, but the examiners and the Administrative Law Judges, the judges who decide Social Security cases, in Nebraska have their own habits. A capable disability lawyer who has worked Nebraska cases understands how the local hearing offices in Omaha and the surrounding region operate.
Top Approved Impairment Categories in Nebraska
Nebraska disability approvals track national SSA patterns:
- Musculoskeletal and connective tissue disorders, meaning conditions affecting your bones, joints, and muscles, including degenerative disc disease, severe arthritis, and back impairments.
- Mental health conditions including major depression, anxiety disorders, PTSD, and schizophrenia.
- Nervous system and sense organ disorders, meaning conditions affecting the brain, nerves, or senses, including multiple sclerosis, epilepsy, and Parkinson’s disease.
- Circulatory conditions, meaning heart and blood vessel problems, including congestive heart failure and post-stroke residuals.
Strong cases pair the right analysis under the Blue Book, Social Security’s official list of qualifying impairments, with detailed documentation from your treating providers about how your condition limits your daily life and work.
How Liner Legal Handles Your Nebraska Disability Claim
Our team starts by reading the file the way the SSA reads it. We look at the medical records, the work history, the daily-life limitations described, and the gaps that drove the denial. We then fill those gaps with updated documentation, treating provider statements, and legal arguments tied to the SSA rules.
Founded by Michael Liner, our firm has served more than 10,000 clients and secured billions in benefits. We prepare Nebraska claimants for the kinds of questions an Administrative Law Judge, the judge who decides Social Security cases, tends to ask, all by phone. We cross-examine the vocational expert, the specialist the judge brings in to argue you could still do certain jobs in the national economy. We frame the case so the judge can grant benefits without searching the file.
If a former employer’s long-term disability policy is also on the table, our team handles those cases as well. See if You Qualify for LTD. It’s the fastest way to get in front of our team.
Our attorneys work on a contingency fee basis, which means nothing up front and no fee unless we win benefits. Federal law caps our fees at 25 percent of past-due benefits.
The Nebraska Appeals Process
You have 60 days from a denial to appeal. The path runs through four levels.
- Nebraska Disability Determination Services, the state agency that reviews your medical records, sends the file back to a new examiner for a fresh look. New medical evidence can be added.
- Hearing in front of an Administrative Law Judge, the judge who decides Social Security cases. This is often where Nebraska Social Security disability cases are decided. If the judge approves your claim, your benefits are awarded from that point forward. The judge hears testimony from you and questions a vocational expert, a specialist who testifies about jobs you might still be able to do, about jobs available given your limits.
- Appeals Council Review. If the hearing decision is also unfavorable, your case moves to the Appeals Council, which checks for legal or procedural errors in how the judge handled it.
- Federal Court. A lawsuit filed in the United States District Court for the District of Nebraska is the final option within that claim. If the case is closed out at this stage, pursuing benefits again means starting an entirely new application from the very first step.

Frequently Asked Questions
A physical or mental condition, confirmed by medical evidence, that prevents substantial work, meaning work that earns more than a set monthly amount, for at least 12 months or is expected to result in death. The Social Security Administration uses this same standard in every state.
SSDI benefits in Nebraska track the federal calculation based on prior earnings, and the SSA publishes the current average on its website. SSI is a needs-based program with a federal benefit rate set annually.
Federal law caps Social Security disability attorney fees at 25 percent of past-due benefits. You pay nothing if the claim does not win.
You don't need money up front. Disability lawyers work on a contingency basis. Disability Rights Nebraska and the Nebraska State Bar Association's lawyer referral service can also point claimants toward additional resources.
Workers Compensation and SSDI Offset in Nebraska
Some Nebraska claimants receive workers’ compensation alongside SSDI. Nebraska workers’ compensation disputes are handled by the Nebraska Workers’ Compensation Court, the state court with exclusive jurisdiction over workers’ compensation claims. Federal law caps your combined SSDI and workers’ compensation benefits at a set share of what you earned before your disability began (Social Security calls this the offset). If the combined amount goes over that cap, Social Security reduces the SSDI payment, not the workers’ compensation payment, until you turn 65 or the workers’ compensation award ends. Liner Legal focuses on the SSDI side and refers workers’ compensation representation to trusted partners through our referral network.
Beyond Disability: Our Referral Partner Network
Did you know you may be entitled to additional financial compensation beyond your disability benefits? Depending on your situation, you could also have a workers’ compensation, personal injury, medical malpractice, or long-term disability claim. At Liner Legal, we’re committed to helping you identify every potential source of financial support so you don’t leave benefits you may be entitled to on the table. While we focus exclusively on Social Security Disability (SSDI/SSI) and Long-Term Disability (LTD) claims ourselves, our nationwide network of trusted referral partners connects clients with experienced attorneys in areas like workers’ compensation, veterans disability, personal injury, employment law, medical malpractice, family law, and more. See if You Qualify for Additional Financial Compensation to find out what else may be available to you.
Nebraska is home to many veterans. Our team focuses on the SSDI and LTD side of your case, and for VA disability appeals, we refer you to VA-accredited partner attorneys through this same network.
