Wyoming Disability Lawyer

Most disability claims are denied on the first try, and the picture in Wyoming is the same. Whether your fight is with the Social Security Administration or a private disability insurance company, the first denial letter is rarely the end. Liner Legal is a nationwide law firm serving Casper, Cheyenne, Laramie, Gillette, Rock Springs, Sheridan and every smaller Wyoming community with Social Security disability appeals and ERISA long-term disability litigation. ERISA is the federal law that sets the rules for most employer-provided disability plans.

The disability claims process is built to favor the side with deeper resources. Insurance companies and government agencies have entire teams reviewing files and looking for reasons to say no. We level the field. Our disability attorneys handle denied disability claims at every stage, from the first appeal to federal court, and we do it nationwide.

How Social Security Disability Works in Wyoming

Social Security Disability Insurance (SSDI) is a federal program that pays monthly benefits to people who have worked and paid Social Security taxes long enough to qualify. You generally need 40 work credits, with 20 of those earned in the last 10 years. Work credits build up through years on the job, and Social Security tracks eligibility that way, so the longer and more recently you have worked, the more likely you are to meet the requirement. Your medical condition also has to prevent substantial gainful activity, meaning work that earns above a certain monthly amount, and it needs to last at least 12 months or be expected to result in death.

Supplemental Security Income (SSI) works differently. It does not require any work history at all. It is a needs-based program limited to people with very little income or resources, and some Wyoming residents qualify for both SSDI and SSI at the same time. Our disability lawyers review your work history, income, and medical records to determine which program, or programs, fit your situation.

How Wyoming Law Protects Disability Claimants

Wyoming law bans discretionary clauses in disability insurance policies. That is a real protection. A discretionary clause lets an insurance company’s decision stand unless a court finds it “arbitrary and capricious,” which is a much harder standard for you to overcome. By outlawing those clauses, Wyoming law puts disability lawyers on stronger ground when fighting a denied disability claim under state policies.

ERISA (a federal law that sets strict rules for employer benefit plans) still governs many employer-sponsored long-term disability (LTD) claims, and it can override Wyoming’s state protections when it applies. Our team identifies which framework applies and frames your appeal accordingly. ERISA sets strict deadlines for filing claims and appeals, and missing one can permanently close your file.

Long-Term Disability Appeals in Wyoming

Long-term disability claims under an employer plan usually fall under ERISA. Your internal appeal is the only chance to add evidence to that record before any federal lawsuit, so if the file going to court is thin, the judge is generally limited to that thin record. Our disability lawyers build your appeal with new medical records, treating physician statements, vocational evidence, and rebuttals to any independent medical exam the insurer relied on.

SSDI and SSI Appeals in Wyoming

Social Security disability claims follow the federal four-level appeals process. Reconsideration, then a hearing in front of an Administrative Law Judge (the judge who hears Social Security appeals), then Appeals Council review, then federal court. If the hearing decision is also unfavorable, the case moves to the Appeals Council, which checks for legal or procedural errors in how the judge handled it. If the Appeals Council also denies the case, filing a civil lawsuit in the United States District Court for the District of Wyoming is the final option within that claim. If the case is closed out at this stage, pursuing benefits again means starting an entirely new application from the very first step. You have 60 days at each stage.

Top Approved Impairment Categories in Wyoming

Wyoming disability approvals track national SSA patterns:

  • Musculoskeletal and connective tissue disorders.
  • Mental health conditions.
  • Nervous system and sense organ disorders.
  • Circulatory conditions.

Why Insurance Companies and the SSA Deny Wyoming Disability Claims

Disability insurance companies deny claims for a familiar set of reasons. Errors in documentation. Insufficient medical records to prove the impairment. Surveillance video used out of context. Independent medical exams that minimize symptoms. Insurance companies prioritize profit, and a denied disability claim costs them nothing if you walk away.

The Social Security Administration denies for parallel reasons. Missing functional evidence. Gaps in treatment. An initial claim that does not connect your medical condition to your inability to work. Both systems reward thorough documentation, and both punish files that are not built carefully.

How Liner Legal Handles Wyoming Disability Cases

We represent disabled workers and residents across Wyoming. Founded by Michael Liner, our firm has served more than 10,000 clients and secured billions in benefits. We focus on three claim types.

  • Social Security Disability Insurance and SSI appeals. We work your claim through reconsideration, hearing, Appeals Council, and federal court when needed.
  • Long-term disability claims under ERISA. We exhaust the insurer’s internal appeals process correctly the first time, because that appeal file, called the administrative record, is the only evidence a federal court can review later if your case goes to litigation.
  • Private disability insurance claims governed by Wyoming law. Because discretionary clauses are banned here, we can argue your case on the merits, without courts automatically siding with the insurance company’s decision the way they do in most other states.

We answer your questions directly. We track strict deadlines so your claim does not miss its window. All client work is handled by phone and secure document exchange. See if You Qualify for LTD. It’s the fastest way to get in front of our team.

What Our Clients Are Saying

Frequently Asked Questions

For Social Security disability cases, federal law caps the fee at 25 percent of past-due benefits. Long-term disability and ERISA cases use a different fee arrangement, which we'll agree on with you up front.

SSDI benefits are based on your prior earnings under the federal formula. Most LTD policies replace 50 to 70 percent of your pre-disability income.

You don't pay anything up front. Disability lawyers, including us, work on contingency, meaning we only get paid if we win your case. Legal Aid of Wyoming also offers free civil legal help if you have a low income.

Social Security disability requires a medically determinable impairment, meaning a diagnosed physical or mental condition, that prevents substantial gainful activity, meaning full-time work at a meaningful income level, for at least 12 months. Long-term disability insurance uses your policy's own definition of disability instead, which is usually narrower and often changes to a stricter standard after 24 months of payments.

Workers Compensation and SSDI Offset in Wyoming

Some Wyoming claimants receive workers’ compensation alongside SSDI. Wyoming workers’ compensation runs through the Wyoming Department of Workforce Services’ Workers’ Compensation Division, the state fund that provides nearly all workers’ compensation coverage in Wyoming. Federal law caps your combined SSDI and workers’ compensation benefits at a set share of what you earned before your disability began (Social Security calls this the offset). Liner Legal focuses on the SSDI side and refers workers’ compensation representation to trusted partners through our referral network.

Beyond Disability: Our Referral Partner Network

While Liner Legal focuses exclusively on Social Security Disability (SSDI/SSI) and Long-Term Disability (LTD) claims, we know many of our clients are dealing with more than one legal issue at once. Did you know you may be entitled to additional financial compensation beyond your disability benefits? Depending on your situation, you could also have a workers’ compensation, personal injury, medical malpractice, or long-term disability claim. Exploring these options does not automatically affect your eligibility for Social Security Disability benefits. At Liner Legal, we’re committed to helping you identify every potential source of financial support so you don’t leave benefits you may be entitled to on the table. Through our nationwide network of trusted referral partners, we also connect clients with experienced attorneys in areas like workers’ compensation, veterans disability, personal injury, employment law, medical malpractice, and family law, so your legal needs beyond disability benefits don’t fall through the cracks. See if You Qualify for Additional Financial Compensation. It only takes about two minutes, and there’s no cost or obligation. For Wyoming veterans, our team focuses on the SSDI and LTD side of things. For VA disability appeals specifically, we refer you to VA-accredited partner attorneys through this same referral network.
