Oklahoma Disability Lawyer

Most disability claims are denied on first review across the Social Security system, and Oklahoma residents face the same odds. A denial doesn’t have to be the end of the story. It moves your case into the appeals process, where many claims that were initially denied go on to win benefits. Liner Legal works Oklahoma Social Security disability cases at every stage of the claims process, from the initial application through reconsideration (a fresh look by a different reviewer), hearing, Appeals Council review (Social Security’s internal review board), and federal court when needed. We serve Oklahoma City, Tulsa, Norman, Broken Arrow, Lawton, Edmond, Stillwater, and every smaller community in between.

Why Most Oklahoma Disability Claims Get Denied

Initial SSDI approval rates are low nationally, and Oklahoma tracks that pattern. Common reasons: insufficient medical evidence, scattered, sporadic treatment, filing errors, failure to meet the 20 work credits requirement for SSDI (the credits you build up over years of paying into Social Security), or for SSI, having countable resources (cash, bank accounts, and other assets Social Security counts against you) over the federal limit.

Types of Disability Programs Available in Oklahoma

SSDI

Social Security Disability Insurance pays benefits to workers who paid FICA taxes (the Social Security and Medicare taxes taken from your paycheck) and have enough work credits to be insured. That’s built through years of work, and Social Security tracks it in work credits, so the longer and more recently you’ve worked, the more likely you are to meet the requirement.

SSI

Supplemental Security Income (SSI) is a needs-based program for disabled individuals with very limited income and other assets below the SSA’s resource limits, the maximum savings and assets you’re allowed to have and still qualify.

Long-Term Disability

Employer-provided long-term disability (LTD) insurance runs separately from Social Security. Many employer policies are governed by federal ERISA rules, the law that sets strict deadlines and a specific appeals process for employer benefit plans.

The Oklahoma Social Security Disability Claims Process

The application process runs through five stages: Initial claim, Reconsideration (a fresh look at your case by a different reviewer), Hearing in front of an Administrative Law Judge (the judge who hears Social Security appeals), Appeals Council review, and Federal court. If the hearing decision is also unfavorable, the case moves to the Appeals Council, Social Security’s internal review board, which checks for legal or procedural errors in how the judge handled it. If the Appeals Council also denies the case, filing a civil lawsuit in the United States District Court for Oklahoma is the final option within that claim. If the case is closed out at this stage, pursuing benefits again means starting an entirely new application from the very first step. You have 60 days to appeal after each denial. Initial decisions usually take three to six months.

Reconsideration adds several months. The hearing stage can take over a year to reach a hearing date depending on the workload at the Oklahoma City or Tulsa hearing offices.

How Liner Legal Helps Oklahoma Residents Win Benefits

Founded by Michael Liner, our firm has served more than 10,000 clients and secured billions in benefits. We prepare clients for hearings by phone, including the kinds of questions Oklahoma Administrative Law Judges tend to ask, and we cross-examine the vocational expert, the job specialist Social Security brings in to argue you can still work, about additional limitations the medical evidence supports. See if You Qualify for LTD if a private policy is on the table.

Our attorneys work on a contingency fee basis, meaning you only pay if we win, so there’s nothing up front and no fee unless we win benefits. Federal law caps our fees at 25 percent of past-due benefits.

Workers Compensation and SSDI Offset in Oklahoma

Some Oklahoma claimants receive workers’ compensation through the Oklahoma Workers’ Compensation Commission alongside their SSDI benefits. Federal law caps your combined SSDI and workers’ compensation benefits at a set share of what you earned before your disability began (Social Security calls this the offset). If your combined benefits go over that cap, Social Security reduces your SSDI payment, not your workers’ compensation award, until you turn 65 or the workers’ comp award ends. Liner Legal focuses on the SSDI side of these cases and refers workers’ compensation representation to trusted partners through our referral network.

Beyond Disability: Our Referral Partner Network

While Liner Legal focuses exclusively on Social Security Disability (SSDI/SSI) and Long-Term Disability (LTD) claims, we know disability is rarely the only challenge you’re facing.

Did you know you may be entitled to additional financial compensation beyond your disability benefits? Depending on your situation, you could also have a workers’ compensation, personal injury, medical malpractice, or long-term disability claim. Exploring these options does not automatically affect your eligibility for Social Security Disability benefits.

At Liner Legal, we’re committed to helping you identify every potential source of financial support so you don’t leave benefits you may be entitled to on the table. Through our nationwide network of trusted referral partners, we connect clients with experienced attorneys in areas like Workers’ Compensation, Veterans Disability, Personal Injury, Employment Law, Medical Malpractice, and Family Law. See if You Qualify for Additional Financial Compensation to find out what else may be available to you.

Oklahoma is home to many veterans. Our team focuses on the SSDI and LTD side; for VA disability appeals, we refer you to VA-accredited partner attorneys through this same referral network.
