Disability Benefits Available in New Mexico
- Social Security Disability Insurance (SSDI). Pays monthly benefits to workers with enough work credits whose impairment prevents substantial gainful activity (work that earns above a set monthly amount) for at least 12 months. That’s built through years of work, and Social Security tracks it in work credits, so the longer and more recently you’ve worked, the more likely you are to meet the requirement.
- Supplemental Security Income (SSI). A needs-based program for disabled individuals with limited income and resources.
- Long-term disability (LTD) benefits through employer plans. Many are governed by federal ERISA rules with strict deadlines.
- Disabled Widow/Widower and Disabled Adult Child Benefits. Family members may qualify on a deceased worker’s record.
See if You Qualify for LTD if a private policy is on the table.
Why So Many New Mexico Disability Claims Get Denied
Most denials trace back to the same handful of issues. Insufficient medical evidence is at the top. So is scattered, sporadic treatment, missing healthcare provider opinions, or a file that does not document how the disabling medical condition affects ability to work. Filing errors and missed deadlines also cost many New Mexico residents claims that should have been approved.

How Liner Legal Handles Your New Mexico Disability Claim
Founded by Michael Liner, our firm has served more than 10,000 clients and secured billions in benefits. Our team starts with the denial letter and the case file. We identify why the Social Security disability claim was denied. We then close those gaps with updated medical records, treating provider statements, and a focused legal theory the administrative law judge, the judge who decides Social Security disability cases, can grant benefits from. All client work is handled by phone and secure document exchange.
Our attorneys work on a contingency fee basis, which means nothing up front and no fee unless we win benefits. Federal law caps our fees at 25 percent of past-due benefits.
The Social Security Disability Process in New Mexico
The disability application process has five stages: initial claim, reconsideration (a second review of your case by a different reviewer), hearing, Appeals Council review (the next level of review after a hearing), and federal court. Each stage carries its own 60-day appeal window. Most initial disability applications across New Mexico are denied, and most requests for reconsideration are denied as well. The shift usually comes at the Social Security disability hearing in front of the administrative law judge, the judge who decides Social Security disability cases. This is often where New Mexico Social Security disability cases are decided. If the judge approves your claim, your benefits are awarded from that point forward. If the hearing decision is also unfavorable, your case moves to the Appeals Council, which checks for legal or procedural errors in how the judge handled it. If the Appeals Council also denies the case, federal court is the final option within that claim. If the case is closed out at this stage, pursuing benefits again means starting an entirely new application from the very first step.
What Our Clients Are Saying
Frequently Asked Questions
A medically determinable physical or mental impairment that prevents substantial gainful activity for at least 12 months. Eligibility requires medical evidence that meets the SSA's standards.

You don't have to pay up front. Disability lawyers work on a contingency fee basis. New Mexico Legal Aid can provide legal advice and sometimes full representation for qualifying claimants.
Workers Compensation and SSDI Offset in New Mexico
Some New Mexico claimants receive workers’ compensation through the New Mexico Workers’ Compensation Administration alongside their SSDI benefits. Federal law caps your combined SSDI and workers’ compensation benefits at a set share of what you earned before your disability began (Social Security calls this the offset). If your combined benefits go over that cap, Social Security reduces your SSDI payment, not your workers’ compensation award, until you turn 65 or the workers’ comp award ends. Liner Legal focuses on the SSDI side of these cases and refers workers’ compensation representation to trusted partners through our referral network.
Beyond Disability: Our Referral Partner Network
Did you know you may be entitled to additional financial compensation beyond your disability benefits? Depending on your situation, you could also have a workers’ compensation, personal injury, medical malpractice, or long-term disability claim. Exploring these options does not automatically affect your eligibility for Social Security Disability benefits.
At Liner Legal, we’re committed to helping you identify every potential source of financial support so you don’t leave benefits you may be entitled to on the table. While we focus exclusively on Social Security Disability (SSDI/SSI) and Long-Term Disability (LTD) claims ourselves, our nationwide network of trusted referral partners connects clients with experienced attorneys in areas like workers’ compensation, veterans disability, personal injury, employment law, medical malpractice, family law, and more. See if You Qualify for Additional Financial Compensation to find out what else may be available to you.
New Mexico is home to many veterans. We focus on the SSDI and LTD side of your case, and for VA disability appeals, we refer you to VA-accredited partner attorneys through this same network.
